Before ordering any products from this website it is necessary for you to read this document (= Terms & Conditions). By placing an order with Simbollist, you confirm that you have read the Terms & Conditions and that you accept them. We also expect you to read and agree with our Privacy Policy which is published on our official website.

BEFORE PLACING ANY ORDER ON THIS WEBSITE YOU MUST READ AND AGREE WITH THE TERMS AND CONDITIONS OF USE PRESENTED IN THIS DOCUMENT. IN CASE YOU ARE UNWILLING TO AGREE WITH THESE TERMS & CONDITIONS, YOU WILL NOT BE ABLE TO PURCHASE ANY PRODUCTS LISTED ON THIS WEBSITE OR OTHER SIMBOLLIST’S ONLINE SERVICES.

About Terms & Conditions

These Terms & Conditions are applicable to all purchases/orders made on the official Simbollist website and other web pages/content owned or used by Simbollist, such as social media pages, e-commerce platforms and other. Simbollist reserves the right to not fulfil orders made by individuals who do not agree with these Terms & Conditions.

The Terms & Conditions may change from time to time and all customers are advised to read this document before first order and before any additional order.

When using Simbollist website or other online Services, you agree to comply with Simbollist’s Privacy Policy.

In case you purchase a product from Simbollist, you are advised to download, save and print a copy of this document for your evidence.

These Terms & Conditions take precedence over any other previous agreement or representation made to you (whether orally or in writing).

If at any time Simbollist does not insist that you comply with the rules and obligations stated in these Terms & Conditions, this does not mean that you are free to ignore them. Simbollist reserves the right to ask you to comply at any time, even at a later date.

These Terms & Conditions have been drawn up in accordance with the EU Directive on consumer rights (2011) and Consumer Protection Act (ZVPot-UPB2).

Intellectual property rights

The name of the brand Simbollist, its logo, all jewellery design, official website content, social media pages content and all other content published by Simbollist are the sole property of Simbollist.

Privacy Policy

We believe that protecting our Users’ personal information is crucial for a pleasant and safe shopping experience. It is one of the core values of our brand.  All personal information collected and processed by Simbollist is regulated and explained by our Privacy Policy.

We expect our customers to carefully read and understand our Privacy Policy.

Placing an order

To buy a product from our website you must:

–        Be at least 18 years old;

–        Read and agree with our Terms & Conditions;

–        Read and agree with our Privacy Policy;

–        Provide the necessary personal information, such as: your name and surname, your address, your email, payment details, other required information;

–        Be the owner or an authorised user of a valid credit/debit card, a Pay Pal account or a Simbollist Gift Card.

To place an order, you must select a product that you would like to purchase and click the button “ADD TO BAG”. At the checkout page you can review your order and check the selected items. There, you can also see the total price of your order and your personal information that you provided. You can correct any incomplete or incorrect information before confirming an order. You are also requested to read and accept the Terms & Conditions.

Order processing and contract formation

Once you place an order with Simbollist, you will receive an Order Confirmation email with the details of the ordered product(s).

After receiving the order, we will verify if the chosen products are in stock. If the relevant products are available, we will dispatch them to you. Once the products are dispatched, you will receive a Shipment Confirmation email. Once the Shipment Confirmation email is sent to your email address, a Contract of Sale between you and us is established. The Contract of Sale is formed once your order is dispatched to you and a Shipment Confirmation email is sent to your email address. In case you do not receive a Shipment Confirmation email within 72 hours of placing an order, please contact us via email.

The Contract of Sale is formed individually for each order. A Contract of Sale will only be formed for the products whose dispatch has been confirmed in the Shipment Confirmation. If you do not receive a Shipment Confirmation email, a Contract of Sale has not yet been formed and we are not obliged to supply the chosen product.  

We will not always be able to accept your order. The reasons for this may be insufficient stock, unusual orders, invalid or suspicious delivery address, invalid credit/debit cards, and other. In case we cannot accept your order, we will inform you by email and any payment already made for that order will be refunded to you.

Cancelling an order

You can cancel your order before the relevant products are dispatched to your address and before you receive a Shipment Confirmation email. Once the products are dispatched and you receive a Shipment Confirmation email, we will not be able to cancel your order. In case you want to amend or cancel your order before you have received your Shipment Confirmation email, please contact us via email. It may not always be possible to prevent the dispatch of the products.

Once you receive a Shipment Confirmation email and the products are shipped to your address, you still have the option to:

1)     Refuse to accept the delivery

Once you receive your order you can refuse to accept the delivery and the products will be returned to Simbollist. The money paid for the products will be refunded to you (see the section Refunds).

2)     Return the products

You can accept the delivery and then return the products in accordance with the rules described in the section Returns & Refunds.

Product prices, taxes and shipping prices

All prices are payable in euro (EUR). Prices include VAT and/or applicable taxes. Prices do not include the shipping fee. Shipping costs can be found under the section Shipping & Delivery that is displayed at the bottom of the website. Shipping prices will be displayed on your screen prior to the completion of your order.

Prices can change at any time without prior notice. Any changes will normally not affect orders for which we have already sent you a Shipment Confirmation email.

In case of a price error, whether on our website or in an Order Confirmation or otherwise, we have the right to correct such an error and charge you the correct price or cancel your order. We will notify you about such occurrence and inform you about the corrected price. In such a case, you have the option to continue your purchase or cancel your order. If we do not receive any response from you, we will cancel your order and return to you the full amount paid for the product(s).  

Inbound duties and taxes

If you place an order from outside the EU, you may have to pay inbound duties and taxes. We do not have any control over these fees and we cannot predict this cost. These customs fees are determined by each individual country. Simbollist does not pay these fees.

Payment

Payment is possible using the following means/methods:

–        Credit/debit card (VISA, MasterCard, Maestro)

–        PayPal

–        Simbollist Gift Card

All approved credit and debit cards get displayed in the checkout process when choosing a payment method. In case we do not receive authorisation from your bank card or other payment service provider, your order will not be accepted.  

Shipping & Delivery

It usually takes up to 5 days for a product in stock to be dispatched. You can expect to receive a Shipment Confirmation email within 5 days from receiving an Order Confirmation. An estimated delivery time to different countries is presented in the table below. The delivery time is not completely dependent on us, so we do not take the responsibility for any delay in delivery. It can take up to 30 days until your order gets delivered to your address.

We do not accept other shipping options at the request of a client except those mentioned above.

There may be certain unpredictable circumstances in which we may not be able to deliver your order. This can be due to technological, organizational or health problems on our side, problems on the side of the third parties with whom we collaborate, public or natural disasters and other occurrences that can hinder the delivery of your order. In that case, we will notify you as soon as possible. You will be provided with two options – you can either wait for your order to arrive with delay or cancel your order, for which you will receive a full refund.

It is very important to provide a valid and correct delivery address. If you provide us with an incorrect address or delay the receiving of your order, the package will be returned to us, your order will be cancelled and you will be refunded.

It is possible to add a PO Box as a delivery address. In that case, you will receive a notice in your letterbox informing you that a parcel is ready to be collected at the post office.

Returns & 30-day cancellation period

According to the EU Directive on consumer rights (2011) and Consumer Protection Act (ZVPot-UPB2), you have the right to cancel and return your order within 14 days from receiving it, for any reason and without a justification. This period of 14 days is the so-called “cancellation period”. We have a 30-day no-questions-asked return policy. It means that you have 30 days to return your order back to us without any explanation on your part. This period starts with the day we send you a Shipping Confirmation email and it lasts for 30 days from the day you receive your order. If during this period you decide to cancel your order, you have to follow the steps described in our Return Process.

The cancellation period applies to both regular-price and sale (discounted) products. It does not apply to Simbollist Gift Cards. We do not accept returns or exchange of Simbollist Gift Cards. You have the right to the “cancellation period” only for the products that you buy on our online shop.   

If you want to exchange a purchased product for the same product of a different size or colour, the same rules apply. You have to return your order in 30 days and place a new order.

Any returned product must be unworn and in resaleable condition. It must not be damaged or showing signs of use or wear.

Return process

In case you decide to return your order, you have to perform the following steps:

1)     Fill in the Return form and print it out. You can download it here: Return form.

2)     Place the jewellery item(s) you want to return, the original packaging and the printed form in the shipment box.

3)     Cut out the paper label with our address and stick it onto the shipment box so that it covers the old address (our address label is at the bottom part of the Return Form).

4)     Take the shipment box to any post office/shipping company that ships internationally.

Exchanging a product for a different size or colour

If the ordered product does not suit you in size or colour and you want to exchange it for a different one, please return the unwanted item to us (through previously described steps) and then place a new order for a different size or colour.

Once we receive your returned order and you place a new one, we will send you a new order, in which case you will have to pay a shipping cost of 10 euros (this is our flat shipping rate in case of exchanges for a different size or colour).

If the item has changed in price since your original purchase, please contact us and we will keep the original price for the new size.

Refunds

If you cancel your order and send the purchased products back to us, we will refund the amount of money you paid for:

–        the product (including VAT),

–        delivery costs (if any).

You will be refunded the full amount you paid for the product(s) as well as for the delivery costs. The maximum delivery costs you are refunded is the flat rate of 10 euros. The cost of a return shipping will be your responsibility and we do not pay for it.

We do not pay for nor refund any exchange shipping costs. That means that if you want to exchange a product for a different size or colour, you have to return the product and place a new order for a different size or colour. The shipping cost of that new order will be your responsibility and it will cost you 10 euros. In case you want to return your newly exchanged product, we will only refund the cost of the product but not the exchange shipping cost that you have paid for (10 euros).

After we receive your returned product(s), we will send you a Return Confirmation email. You will be refunded within 14 days after the day on which we receive the returned product(s) back from you or withing 14 days after the day on which you provide us with the evidence that you have sent the product(s) back to us.

If you cancel your order and the products have not been dispatched to you, we will refund the money within 14 days after you inform us of your decision to cancel the order.

The refund is made using the same method as for the purchase of your order. For example, if you pay by credit card, the refunded money will be sent to your credit card.

In case the returned product(s) are damaged and are not intact, we have the right to refuse your return of the product(s). A damaged product is considered an object that contains scratches, abrasions or other forms of damage that lower its value. In that case, you are not entitled to a refund. The same rule applies to packaging boxes.

In case you have received a refund before your returned products have arrived back to us, and we later discover that your returned products are damaged, you will be obligated to pay a certain amount of money or the full price of the product.

If you do not return the products or the products fail to arrive, we have the right to deny the refund. Return shipments are at the buyer’s risk. This means that any damaged or lost items during return are the sole responsibility of the buyer. We do not pay for damaged or lost items. Ask your selected shipping company about your rights and options in the event of damage or loss.

Returning products that are faulty and a 2-year guarantee

According to the EU Directive on consumer rights (2011) and the EU Directive on certain aspects of the sale of consumer goods and associated guarantees (1999), you have the right to request a repair or replacement free of charge if the product you have ordered is faulty or not as described on our website. This guarantee lasts up to 2 years from the day you have received your order. If in this period it turns out that your ordered product is faulty or not as previously described, you can return it to us and we will repair or replace it with a product of identical or similar characteristics free or charge. You are entitled to claim the defect within 2 months from its discovery.

This 2-year guarantee does not cover product damage due to everyday wear and tear, accidents and improper use.

After you send the product back to us, we will inspect it to either verify that the issue can be easily and promptly solved or determine if there are any obvious reasons to declare the warranty void (e.g., expiry of the warranty, obvious presence of accidental damages or damages caused by the consumer). We will notify you via email what option is available in a given situation.

There is a possibility that we will not be able to repair or replace a faulty product due to manufacturing reasons, time limitations or different organizational reasons. If that is the case, we will refund your money or offer you a price reduction. The final decision regarding the faulty product will be made after the product is returned back to us and we have determined what solution is possible and is the most suitable in a given situation.

When returning a faulty product and reclaiming a refund under the 2-year guarantee described above, you are required to show us your Order Confirmation email or bank statement proving the transaction for the relevant product.

If the faulty product is repaired or replaced under this guarantee, the new item will benefit from the remainder of the term of this guarantee. The period of this guarantee is not extended for the new item. 

As permitted by law, the total liability of Simbollist shall be limited to the amount actually paid for the purchase of the product(s) and the amount paid for the delivery. 

Severability

If any provision of these Terms & Conditions is considered unlawful, void or for any reason unenforceable, that provision is deemed deleted from these Terms & Conditions, and this will not affect the validity and enforceability of any remaining provisions.

Third party rights

The only ones that are entitled to enforce any of these Terms & Conditions are Simbollist and the customer who has placed an order and established a sales contract with Simbollist.  

We will do our best to answer your questions and/or resolve any complaint you might have. If we are unable to resolve a complaint or dispute, both parties have the right to seek further assistance through ODR Platform, operated by the European Commission, which is providing customers and companies in the EU with tools for resolving online sales disputes without going to court. The dispute resolution services available on the Platform are available free of charge.
